Ruskin Fitness Club – Terms & Conditions

FINANCIAL TERMS

1.       Initial payments, membership plans, and associated fees are outlined in the online membership application.

2.       Memberships can be paid in full via a lump sum or monthly via Direct Debit.

3.       All Direct Debit memberships are subject to a minimum 12-month contract term. By choosing to pay monthly, the member agrees to remain liable for monthly payments for the full 12-month term unless otherwise permitted under these Terms & Conditions.

4.       Members who choose to pay for 12 months up front will receive one month’s free membership. Advance memberships are non-refundable.

5.       For Direct Debit payments, members must make a pro-rata payment followed by their first Direct Debit instalment, collected in advance on the 1st of each month.

6.       If a Direct Debit payment is returned unpaid for reasons other than banking error, or any other payment is declined, a £15 administration fee will be charged in addition to the outstanding amount.

7.       If paid within 7 days the fee may be waived.

8.       If unpaid and a second payment is missed, membership may be cancelled.

9.       Unpaid balances may be passed on to a debt collection agency.

10.    Membership fees and collection dates may be adjusted periodically. Monthly members will receive at least one month's email notice. Lump-sum plans are unaffected until renewal.

11.    Membership fees are non-refundable. Lump-sum memberships may be frozen in exceptional cases at management discretion.

12.    Changes to membership plans may incur an administration fee. No refunds will be given for downgrades.

ACCESS & USAGE

13.    All members must complete an induction on the safe use of equipment before using the facilities unless opted out.

14.    Only individuals aged 18 or older may use the club.

15.    Members must create an online account.

16.    To prevent unauthorised use, members must upload a photograph or have their photo taken.

17.    Memberships are non-transferable and can only be used by the registered member.

18.    Members must not knowingly allow non-members to gain entry. This will result in membership being terminated.

19.    Members without access to their online account or a valid membership card may be denied entry or required to pay a visit fee.

20.    We reserve the right to change or withdraw membership types with a minimum of 28 days’ notice.

21.    Off-Peak access 8:30AM - 4:30PM only. Failure to leave by 4:30PM may result in termination or additional fees.

22.    Admission may be refused when the facility reaches maximum capacity for health and safety reasons.

23.    Facilities may occasionally close due to maintenance or unforeseen circumstances without compensation.

24.    Bank Holiday Opening Hours: The Club's opening hours on Bank Holidays are 7:00am to 6:00pm. These hours may be amended where required, with notice provided where reasonably practicable.

25.    A valid government-issued photo ID is required upon registration to verify identity and ensure the safety of our members

GUEST PASSES

26.    Guest passes may be offered at the Club's discretion and are subject to availability.

27.    Guests must be accompanied by the sponsoring member unless otherwise authorised by management.

28.    Guests must complete any required registration process and provide valid government-issued photo ID upon request.

29.    Members are responsible for ensuring their guests comply with all Club rules and policies.
The Club reserves the right to refuse admission to any guest without providing a reason.

MEMBERSHIP FREEZE

30.    Members may request to freeze their membership for medical reasons (e.g., illness or injury). Requests must be submitted in advance via email to info@ruskinfitness.com.

31.    Monthly members must keep Direct Debit active during freeze. No credit is provided for partial-month freezes. If a direct debit is cancelled, the membership will be terminated with no refund.

32.    Memberships may be frozen for 1-3 months in a yearly period.

33.    If membership is cancelled while frozen, after the initial term (12 months), one full monthly payment will be required as a notice period.

CANCELLATION POLICY

34.    Direct Debit memberships are minimum 12-month contracts. After the initial term (12 months), members must provide 30 days written notice. Early cancellation only where legally required.

35.    Cancellation requests must be emailed to info@ruskinfitness.com.

36.    One final payment will be collected after notice. Example: notice 20 June, payment 1 July, expiry 31 July.

37.    Do not cancel Direct Debit before final payment.

38.    Rejoining after cancellation incurs current joining fees and rates.

39.    If a member fails to cancel their direct debit or provide valid written notice, the gym retains any payments received.

40.    Failure to provide notice or cancelling Direct Debit early will result in recovery/retention of contractual fees.

41.    Advance payment memberships cannot be cancelled mid-term. They will automatically expire at the end of the term unless renewed.

42.    We may cancel a membership if:

A.       A serious or repeated breach of membership rules occurs.

B.       Membership fees remain unpaid 30 days after the due date.

C.       False information was provided during sign-up that affected our decision to grant membership.

D.      If membership is terminated for these reasons, we reserve the right to retain payments to cover incurred costs.

43.    Membership may be suspended or terminated if a member:

A.       Causes injury, damage, or theft.

B.       Uses offensive language or behaves irresponsibly.

C.       Violations of club Etiquette & Safety.

44.    Online sign-ups have a 14-day cooling-off period with pro-rata refund if not used.

ETIQUETTE & SAFETY

45.    Food may only be consumed in designated lounge areas.

46.    Members must follow instructions from staff and management.

47.    All club signage and rules must be adhered to.

48.    Members must not use facilities under the influence of alcohol, drugs, or medications that cause drowsiness.

49.    Members with medical conditions (e.g., diabetes, heart disease) must obtain medical clearance before exercising.

50.    Members participate in physical activity at their own risk and are responsible for ensuring they are medically fit to use the Club's facilities. Members should not undertake exercise beyond their own abilities and should immediately stop exercising if they experience pain, dizziness, discomfort or any adverse symptoms.

51.    Members should seek medical advice before exercising if unsure of their physical capability.

52.    Members must inform the club of any changes to their medical condition or contact details.

53.    Members are encouraged to provide and maintain up-to-date emergency contact information. The Club may contact the nominated person in the event of a medical emergency or other urgent incident occurring on Club premises.

54.    Appropriate gym attire and footwear are required.

A.       Swimwear must be worn in pool areas.

B.       T-shirts and training shoes must be worn in the gym.

C.       Sliders are not permitted in the gym.

55.    Pool users must shower before entering and between facility use.

56.    No inflatables, flippers, or unauthorized equipment are allowed in the pool.

57.    Running and diving are not permitted in the pool area.

58.    Smoking and vaping are prohibited.

59.    Mobile phone use is not allowed in the pool area.

60.    Photography and video recording are restricted to designated areas and require consent from those appearing in them.

61.    No heavy petting.

CLASS BOOKINGS & ATTENDANCE

62.    Classes must be booked via the gym app and are available on a first-come, first-served basis.

63.    Cancellations must be made at least 1 hour before the class starts.

64.    Failure to cancel within 1 hours will result in a late cancellation or no-show record.

65.    Members with three or more late cancellations/no-shows within 30 days will be temporarily restricted from booking classes for 7 days.

66.    Members arriving more than 10 minutes late may not be permitted to join the class and will be classes as a ‘No Show’

67.    The gym reserves the right to cancel or reschedule classes.

LIABILITY & MISCELLANEOUS

68.    Members are responsible for their belongings. The club is not liable for lost, stolen, or damaged items.

69.    Overnight locker storage is not permitted. Items left overnight will be removed and held for 3 days.

70.    Any property found on Club premises should be handed to a member of staff.
Lost property will be retained for a maximum period of 3 days where reasonably practicable.
Items not collected within this period may be donated, recycled or disposed of at the Club's discretion.
The gym reserves the right to open lockers if misuse is suspected.

71.    Members should arrange their own insurance for injuries or lost property.

72.    For the safety and security of members, visitors and staff, CCTV operates throughout the Club and surrounding premises. Images will be processed and retained in accordance with applicable data protection legislation.

73.    The club reserves the right to amend these terms and conditions at any time.

REFERRAL OFFER TERMS & CONDITIONS

74.    The Referral Offer is available only during promotional periods advertised by the Club.

75.    Active members may refer friends, family members or colleagues who are not current active members of the Club.

76.    To qualify, the referred person must join on a qualifying membership and provide the referring member's name at the time of joining. Referrals cannot be claimed retrospectively.

77.    The referring member will receive a voucher redeemable against food, drinks and spa treatments at the Club.

78.    The voucher will be issued within 60 days of the referred member joining and making their first membership full monthly payment when joining on a 12 month contract.

79.    Vouchers are valid for 6 months from the date of issue, are non-transferable, non-refundable and cannot be exchanged for cash.

80.    The Club reserves the right to verify eligibility and withhold rewards where the terms of the promotion have not been met.

81.    The Referral Offer may not be used in conjunction with any other referral promotion unless expressly stated.

82.    The Club reserves the right to amend, suspend or withdraw the Referral Offer at any time.

83.    Any misuse, abuse or fraudulent activity relating to the Referral Offer may result in disqualification from the promotion.

84.    Existing members rejoining the Club within 12 months of cancelling their membership will not be treated as new members for the purposes of this promotion.

CAR PARK

85.    Parking facilities are provided for the convenience of members and visitors only.
Vehicles are parked entirely at the owner's risk. The Club accepts no responsibility for loss, theft of, or damage to vehicles or their contents.

86.    Members and visitors must comply with any parking restrictions, signage and designated parking areas.

87.    The Club reserves the right to take appropriate action in relation to vehicles parked in breach of Club rules.

PERSONAL TRAINING

88.    Members may not provide personal training, coaching, fitness instruction or any other commercial services within the Club unless expressly authorised in writing by management.
Any member found conducting unauthorised personal training or receiving payment for services provided on Club premises may have their membership suspended or terminated.

FACE RECOGNITION

89.       Ruskin Fitness uses face recognition technology provided by CCTech Ltd to control access to our facilities.

90.       Your facial image (biometric data) is collected and processed for the purpose of verifying your identity and managing access under your membership. Ruskin Fitness is the Data Controller and CCTech Ltd acts as the Data Processor.

91.       Your biometric data is processed as necessary for the performance of your membership contract and with your explicit consent. Your image, membership ID, first name and surname are securely stored on UK-based AWS servers and secure local servers at Ruskin Fitness sites where face recognition is in use. Access is restricted to authorised personnel only.

92.       Your biometric data will be retained for the duration of your membership and for six (6) months after your membership ends, after which it will be securely deleted unless required by law.

93.       By signing your membership agreement, you consent to the collection and processing of your biometric data for the purposes described above.
